Art Commissions TOS

Please read terms of service carefully before sending a commission request.

General

Client must be 18 years or older to place an order.Commissioning from me means client has read and agreed to my TOS.I have the right to decline any commissions that I feel are beyond my capability of producing, or cover subjects that I disagree with.I have the right to halt and cancel the commission based on certain circumstances (ex. Medical emergencies, family emergencies, client becomes disrespectful and impractical, ect). Upon cancellation I will give a partial refund.

Payment

Payment must be USD currency.Commissions $30 and under are 100% upfront payment.Commissions over $30 are 50% upfront payment. The final illustration will not be sent until full payment has been sent.Partial refunds are given under certain circumstances. Partial refunds are determined by the stage of the commission.

Revisions

During the sketch phase all revisions are unlimited and free of charge. After the sketch is approved please keep revisions to a minimum. Major revisions past the sketch phase (ex. Pose, concept change, ect) will incur a charge, however minor changes (ex. Changes to colors, etc) will remain free.

Deadline and Delivery

Keep in mind that I am fully employed and work 40 hours a week; I cannot provide an exact date of completion. The complexity of the illustration and communication between the client and I determines the delivery time of the commission. Simple commissions like chibi or sketch requests may take up to two weeks, while full body full rendered character commissions with backgrounds can take four weeks or longer. If you need the commission to be completed by a certain date please communicate that with me and we’ll work something out.

Intellectual Property Rights

The client is allowed to claim the rights of their character(s). However, I retain all rights to the artwork and all stages of the illustration (sketches, linework, etc).I retain the rights to use the illustration in my portfolio, and to post on all my social media accounts.Client may not:

  1. Claim the illustration as their own

  2. Alter, transform, or build upon the final illustration

  3. Use artwork to generate revenue.

  4. Reproduce artwork for merchandise (ex. Shirts, keychain, etc)

  5. Use the artwork for NFT, blockchain, crypto purposes

  6. Feed Illustration to AI

Uses

All commissions are for personal use only. Meaning the client may use artwork as a social media banner or profile photo, or simply upload to social media with given credit and linked back to any of my social media accounts.The client may not use artwork for commercial purposes. If the client request to use artwork for commercial purposes there will be a fee applied to their order; this fee varies depending on the use of the illustration.
